The The Urgency of Taking a Guilt Free Little Break During Heavy Flow
A Feminist Legal Perspective
Abstract
This research aims to examine the urgency of women's right to rest during heavy menstrual flow without guilt from the perspectives of feminist law and psychological health. The method used in this research employs a qualitative approach with a literature review of laws and regulations, academic journals, scientific articles, and conceptual analysis using the framework of feminist legal theory. The research findings indicate that current policies regarding menstrual leave are still optional and often overlooked, highlighting the limitations of legal protection rooted in patriarchal social norms that stigmatize menstruation. Guilt and social stigma reinforce gender inequality and hinder the implementation of women's rights. The advice provided included the need for legal reform and changes in social norms to fairly recognize women's reproductive rights, as well as the need to broaden public understanding of the importance of rest as a basic right that should not be viewed as laziness. The novelty of this research lies in its conceptual approach, which integrates feminist legal and mental health perspectives to support inclusive and humanistic policy efforts in the context of employment and women's rights.
